Right to hold personal information

Article 89 of the GDPR and section 19 and schedule 2 part 6 of the Data Protection Act 2018 sets out the special rules for archiving purposes in the public interest. The guiding principle remains, namely that record creators and archive services can continue to process personal data in their collections for archiving purposes but should not cause substantial distress or substantial damage to the person whose data is being archived. Generally, processing for archiving purposes that has been legal under the Data Protection Act 1998 continues to be lawful under the 2018 data protection law.

Right to be Forgotten

In accordance with Article 17 of the GDPR, the right to be forgotten (also known the right to erasure) the data subject shall have the right to obtain from the controller the erasure of personal data concerning them without undue delay and the controller shall have the obligation to erase personal data without undue delay.

However, if the personal data has been archived in the public interest or for historical research purposes in accordance with Article 89 of the GDPR, the right to be forgotten does not need to be observed, if likely to render impossible or seriously impair the achievement of the objectives of that processing.

Right to refuse sale

We reserve the right to refuse permission on the use and sale of images without providing explanation.

Copyright permissions

We are committed to making collections accessible to users online, and endeavour to mitigate risk of damage to third parties by checking the copyright status of material wherever feasible and, where possible, by contacting rights-holders for permission to make material available.

In making collections and services available online we act in good faith. However, we recognise that despite best efforts there may be occasions when material made available online is considered to breach copyright. If you are concerned that you have found material on our website for which you as a copyright owner have not given permission, or that relates to other specific matters, you have the right to send us a takedown request. We aim to resolve takedown requests quickly and to the satisfaction of all parties.
